- Engaging in any other conduct that restricts or inhibits anyone's use or enjoyment of the services, or which, as determined by Tailorfitting, may harm Tailorfitting or users of the services or expose them to liability.
Any violation of these prohibited activities may result in immediate termination of your account and may subject you to civil or criminal liability.
5. Content Ownership
All content, features, and functionality on the services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and software, are the exclusive property of Tailorfitting or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the services for your personal or internal business purposes. This license does not include any resale or commercial use of the services or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the services or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.
All rights not expressly granted to you in these Terms are reserved by Tailorfitting. Any unauthorized use of the services or its contents may violate copyright, trademark, and other laws, and could result in criminal or civil penalties.
6. User-Generated Content
Users may have the opportunity to submit, post, or otherwise make available content through the services ("User-Generated Content"). By submitting User-Generated Content, you grant Tailorfitting a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
You represent and warrant that you own or have the necessary rights to the User-Generated Content you submit and that the submission of such content does not violate any third-party rights, including intellectual property rights, privacy rights, or rights of publicity. Tailorfitting is not responsible for any User-Generated Content and does not endorse any opinions expressed in such content.

7. Payment Terms

9. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Tailorfitting, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
In no event shall Tailorfitting’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services during the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
10. Termination
These Terms are effective until terminated by either party. You may terminate these Terms at any time by discontinuing your use of the services and deleting your account. Tailorfitting may terminate these Terms and your access to the services at any time, without notice, for any reason, including but not limited to your breach of these Terms.
Upon termination, your right to use the services will immediately cease, and you must discontinue all use of the services. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Termination of your account does not relieve you of any obligations to pay any outstanding fees or charges incurred prior to termination.
